Use of Our Services

You agree to use our services only for lawful purposes and in accordance with these Terms.

You may not attempt to disrupt or harm our systems, interfere with others' use of the services, or reverse engineer our software.

Payments and Third-Party Services

Payments for art commissions or digital goods are processed through trusted third-party services, such as Ko-fi, Steam, itch.io, Stripe, or Fourthwall.

We do not process or store your payment information directly. All transactions are subject to each payment provider's terms and policies. Refunds for purchases made through third-party platforms are handled by those platforms according to their respective refund policies.

User-Generated Content

Some services may allow users to submit content (e.g., artwork, usernames, or messages). You retain ownership of any content you create but grant us a limited license to display or use it within our services.

We reserve the right to remove any content that violates laws, infringes on others' rights, or disrupts the community.

notetaku

notetaku stores all data locally on your device. You are responsible for maintaining your own backups.

If you enable the optional Google Drive sync feature, you are responsible for your sync passphrase. If lost, encrypted data stored in Google Drive cannot be recovered by KiMCHiSOFT. You may revoke notetaku's access to Google Drive at any time through the app's settings or through your Google account at https://myaccount.google.com/permissions.

All services, software, and content are provided "as is" and "as available."

Use of our services is at your own risk. We make no guarantees of uninterrupted operation, security, or accuracy. KiMCHiSOFT LLC is not responsible for damages, data loss, or other harm resulting from the use or inability to use our services.

Termination

We reserve the right to suspend or terminate access to any online service at our discretion, including for violations of these Terms or attempts to disrupt our systems.

Governing Law

These Terms are governed by the laws of the State of New Mexico, USA. KiMCHiSOFT LLC is a New Mexico Limited Liability Company (Entity ID: 0008026825). You agree that any legal action or dispute arising from these Terms shall be handled exclusively in the courts located in Albuquerque, New Mexico.

Updates to These Terms

We may update these Terms from time to time. Changes take effect immediately upon posting. The effective date at the top of this page will be updated accordingly.
